A Maun Magistrates Court has issued an eviction order against socialite and businesswoman, Malebogo Busang, for allegedly failing to pay outstanding rental for her restaurant at Nhabe Museum premises.
Busang, who operates the popular ‘Kana Jang’ restaurant and coffee shop, allegedly owes the museum more than P48 000.00 which accumulated over eight months.
Magistrate Mmoloki Sibanda ruled against the 43-year-old Busang, who is said to have been evading court appearances ever since the case was registered in October 2017.
The order which was effective from yesterday (Monday 29th) instructs that Busang be evicted from the premises, cancels the lease agreement and it also requires Busang to pay all the outstanding arrears.
Should she fail to honour the court order, Busang will have her property auctioned to settle the debt or face civil imprisonment.
An Administration Ofiicer at Nhabe Museum, Joyce Malema, last week pleaded with the court to take action against Busang whom she said was uncooperative. “I have tried to call Busang many times but her phone is always off, her attorney Mr Phoi has also switched his phones off and the case has been postponed many times due to their absence in court. We keep waiting for people who are aware of the mention dates yet they do not turn up,” said Malema as she pleaded with the Magistrate to do something about the case.
Magistrate Sibanda considered Malema’s plea and ruled in favour of the Museum as the defendant was nowhere to be found. “Due to default of appearance, I will deliver a judgment in favour of the plaintiff,” ruled Magistrate Sibanda.
