A Tatisiding man convicted of molesting a minor was to know his fate today. (Friday) in the Francistown magistrates’ court.
The 39-year-old HIV positive man, who cannot be named on health reasons had pleaded innocent to a single count of defilement of a girl under the age of 16 years.
In his defence the man from Gulubane ward in the north-eastern part of the country whose HIV status was produced in court claimed that he had a love affair an 11 year old.
He was convicted by Francistown principal magistrate Thebeetsile Christian Mulalu on overwhelming evidence by the State.
The court proved that on July 5, 2008 at his lodgings at Tatisiding village, the man had carnal knowledge with the minor when she was drunk after imbibing about four bottles of Smirnoff Storm.
Convicting the man, Mulalu said: “The key witness in this matter gave evidence in a chronological manner. She laid the matter in sequence well despite the fact that the incident transpired some years back.”
Particulars of the offense are that on the fateful day, the accused person met the 11 year old girl and her friend at a bar in the village. The friend to the complainant knew the accused person and approached him to request for some money to buy beer, the court heard.
The accused person then lured the two young girls to his place where he gave the friend to the complainant a P100 note to go and buy bottles of Smirnoff Storm, it was said in court.
The complainant further told the court that after drinking her friend went to see another friend, leaving her with the accused.
“When she came back she caught us red handed having sex with the accused person after he had forced me into the act as compensation for the beer he had bought me,” said the complainant during trial.
