Miss Universe Botswana 2013, Tsaone Macheng’s hope to participate in the upcoming Miss Universe pageant in Moscow has been put under threat.
At the centre of the queen’s possible dashed dreams are eight disgruntled Miss Universe Botswana finalists who filed an urgent application with the high court last week challenging Macheng’s win.
They argued that she was chosen the winner in an unfair manner based on arbitrary, whimsical and prejudicial decision contrary to the rules of the game.
During the hearing of the ‘urgent’ case this week by Justice David Newman, the young women claimed that when they entered the beauty competition they were told that the winner should have garnered 40% of the marks from the boot camp and 60% from the stage parade.
They further stated that to their surprise they were informed that the judges had decided to deviate from the above criteria and instead choose the winner based on marks from the activities of the grand finale only.
On Wednesday, Judge Newman ordered that, the Miss Universe Botswana organiser Sesafeleng ‘Safie’ Sekgwa and his team return to court next month to show cause why plans concerning the preparation for Macheng’s involvement in the upcoming Miss Universe pageant at Moscow should not be interdicted and suspended.
They were also advised to show cause why the contract entered into between the applicants and the crowned queen should not be set aside, declared illegal and null and void.
Judge Newman further said the contracts between the contestants and Miss Universe were entered into with applicants, who are under disability and emancipated minors, without legal capacity to contract and without being duly assisted by their parents or legal guardian.
“You should show cause before this honourable court why this honourable court should not declare that the winner of Miss Universe Botswana 2013 pageant be stripped of her crown owing to the prejudged, predetermined, biased, irregular and unfair manner in which she was crowned.
You should also show cause why the winner should not be interdicted and prohibited from carrying out any duties at Miss Universe Botswana pageant 2013, including leaving the jurisdiction of this court as Miss Universe Botswana or to such other places in Botswana in the said capacity,” the judge said.
