Old age turned into a saving grace for a 66-year-old man who raped an 11-year-old boy when court sentenced him to only six (6) months in jail.
Tebogo Kganne of Tati-Siding Village escaped over five (5) years in jail this Monday when Francistown Magistrate Thebeetsile Mulalu tempered justice with mercy and reduced the old man’s sentence.
He had initially sentenced him to 12 months in prison and suspended the other six (6) months on conditions that he does not commit a similar offence in the next two years.
Magistrate Mulalu said the fact that Kganne will be 70 years in not more than five (5) years justified a less severe sentence.
“A longer imprisonment term would be severe and it must be reserved for extreme cases,” he said.
Sentencing Kganne, Mulalu said he considered that the old man forced his penis into the young boy’s anus and in the process rupturing the rectum.
“The boy is said to have complained of severe pains. When he screamed due to excruciating pains, the accused removed his penis and inserted it between the boy’s thighs to satisfy his libido.”
The magistrate said he also took into consideration the fact that Kganne was not in his right state of mind when he committed the offence.
He commended the little boy for boldly testifying about the ordeal which leaves a permanent ugly mark in his memories.
