A 67-year-old man who claimed his relationship with an eight-year-old girl was a mutual love affair, has been found guilty of rape.
Kemoiponetse Olebile from Marapong was convicted on the overwhelming evidence of the state, and although he did not dispute having sex with the girl he insisted that she consented to the act.
He told the Francistown court that the youngster was his girlfriend and they were deeply in love.
Convicting the old man, principal magistrate Kgololesego Segabo rejected the idea that the sexual act between him and the young girl three years ago was consensual.
“The complainant was only eight years old at the time of the incident.
How can an eight-year-old girl consent to a sex act?” he asked.
The magistrate added that there was no way Olebile could have mistaken the tiny, young and innocent looking girl to be someone older.
Olebile has been ordered to undergo HIV testing and is expected back in court on 12 April for sentencing.
