A woman who dragged her former boyfriend to court demanding back the underwear which she had bought him as gifts had her day in court as she got what she wanted.
Besides losing his undergarments which her ex-girlfriend Gaaratwe Lebekwe, 30 went and collected from his house Phetogo Poonyane, 37 was also fined P864 which he should pay end of December.
“Since you (Lebekwe) have taken back the underwears and other clothing items, he would compensate you with P864. The money is for the mobile phone, the P80 he borrowed from you and pots,” said Gaborone Customary court‘s Kgosi Dikwalo Monametsi in his ruling.
He further said if Poonyane failed to pay the money in time, he would be in contempt of court and therefore court would confiscate his property, auction it and pay Lebekwe.
“If he does not have any property and fails to pay, he would then be sent to a six months prison and the complainant would not get anything,” Monametsi stated.
Poonyane who is a Security guard told the court that he needed more than three months to pay off the debt since he was earning P800 a month and paying child maintenance to the same woman.
Monametsi did not give him more time to explain about his debts and instead advised him to stick to one woman if he did not want to find himself in debt.
“If you were not running from one woman to the next, you would be with this woman and caring for your child. You would not have to be paying through the courts,” Monametsi pointed out.
Outside court, Poonyane expressed his disappointment at the judgment.
He explained that he was hoping that the court would give him more time to pay because he was already paying Lebekwe P250 every month for child support and he has to pay rent, buy food and commute to work.
“I am not sure I want to appeal. I have to consult with my family first. At the moment I am disappointed and stressed,” Poonyane said.

I wonder if the courts want to tell us that gifts given when people are in a love relationship are loans. This judgment sets a dangerous precedent. What will happen if man also start to demand gifts they have given to their lovers. Let us be mindful of the fact that some lovers have built houses, bought cars and groceries for those they are in a relationship. Should these groceries be commuted into cash and men be re-imbursed. I wonder also what law advised this judgemnt. In any case its not only man who have spent on their loved ones, women have spent a lot to, more than not like this one who cries over underwears. Sometimes when people take certain actions, they should think of the their family names. I know two people with the Lebekwe surname and I also schooled with another with the Poonyane surname. And when I read this story, my mind immediately flashed to them.
This judgement is wrong. Iam sorry to say that. These two were in love at one point, does this mean that basadi fa ba neela banna dimpho its a loan and when men give to women its a gift. there is something wrong here.this guy o tshwanetse go apeala, to this judgement
